CLAY, NEW YORK — A disgruntled customer who found spit in his drink after visiting a Chili's restaurant in Clay, New York, is suing the company that owns Chili's, the franchise owner and a former waiter.
After having dinner at the Chili's restaurant in Clay, New York, as they did almost once a week, Ken Yerdon, Julie Aluzzo-Yerdon and their 12-year-old son were driving home when Ken found something disgusting in his to-go drink.
The Yerdons contacted police, who performed a DNA test on the drink. The results showed that the spit belonged to Greg Lamica, 25, the waiter who had served the plaintiff and his family on July 28th.
Lamica had initially denied having spat in Yerdon's drink, but when he was confronted with the DNA evidence he admitted to his disgusting act. Lamica was charged with disorderly conduct, for which he had to pay a $125 fine and is serving a one-year conditional discharge sentence.
Now Yerdon is suing the owner of the Chili's location for letting Lamica continue to work there even though they knew about the incident, along with Lamica for psychological trauma, and Pepper Dining Inc., the franchise that owns Chili's, for not handling the incident appropriately.
