Mass Tort Law deals with large numbers of plaintiffs. Each individual case is treated on their own merits. If there are hundreds of thousands of plaintiffs, very few will go to trial. The remaining cases will settle based on the precedent set through the cases that do go to trial. This is different from a Class Action case where a large group of individuals go to trial in a single case, and they split the profits equally after attorney’s collect their fees.
