Natural law theory is the philosophy which states that certain laws and moral values are inherent in human nature. There is a whole bunch of philosophers known as natural theorists. So we’ll learn more about this philosophical theory in this video.

What is Natural Law Theory?

Natural law theory is a legal theory that recognizes how law and morality are deeply connected. It is a universal law, which means it applies to each and every person.
It is a philosophy that tells what is good or bad, right or wrong.

For example,
It is universally accepted that killing someone is wrong. But punishing someone for killing is right.
Even if the act of killing is in self-defense, it is strictly prohibited.

Natural Law in the American Legal System

In American Legel System, natural law is the legal theory that considers law and morality to connect with each other that they are practically the same.

So American Legal System accepts the following points of natural law theory:

Morality motivates the laws created by humans as opposed to being created by any government.

Natural laws are those laws endowed by birth and protected by the government.

Everyone has the same right to liberty, life, and pursuit of happiness.

Everything in life has a purpose, and a human’s goal is to live a happy life.

Any behavior that obstructs it is immoral or punishable.
