Commercial Insurance Claim Denied - What makes a denied claim improper?
Kelly Kubiak, Esq. discussing denials in commercial insurance claims. Often times, when an insurance company denies a claim, to most everyday persons, the denial appears proper. The insurance company might quote some excerpts from the insurance policy, that might appear applicable, and thus are simply accepted.
Kelly Kubiak, Esq. here, letting you know, it really pays to look a little bit closer sometimes. If you have machinery or a product and your insurance company claims that your denied insurance claim is based on "wear and tear" and therefore cannot be covered, it is recommended that you take a closer look into the claim. For example, if the machinery or product you purchased was intended to last a quoted 15-20 years or so, and that is when it is depicted to naturally wear and tear to the point where it would no longer be usable, then that would be a valid defense.
If the wear and tear of your machinery or product occurs in an unnatural time period or if it was improper to last the amount of time that it did, then in turn, the denial basis is improper as well. So, if ever you as a policyholder, receive a denial on a commercial insurance claim, it is highly recommended that your denial be reviewed.
