When a property is transferred from one person to another, this transaction is formalized through registration at the sub-registrar’s office after payment of certain dues like stamp duty. As per the provisions of the Indian Registration Act, 1908, the law provides for the registration of various documents.
Under Section 17 of the Registration Act, all transactions that involve the sale of immovable property for a value exceeding Rs 100, should be registered. Even though the donor does not receive any monetary consideration in exchange for the property, the gift deed has to be registered to get legal validity. Also, all transactions of a lease for a period exceeding 12 months are also mandatorily required to be registered.
