T Visa or VAWA self-petition: which one is right for you? In this video, we'll explore two essential paths for those in difficult or abusive situations: the T Visa and the VAWA (Violence Against Women Act) self-petition. Both options can get you a green card, but depending on your circumstances you might one to go with one over the other.
The T Visa is designed to protect victims of labor or sex trafficking, while the VAWA self-petition is meant to safeguard relatives of U.S. citizens or green card holders who have suffered extreme cruelty or battery by their family members. These two cases have different requirements, but they also have a lot of overlaps and similarities, especially if you have been labor trafficked by your partner.
We'll go in-depth into the situations where you might choose the T Visa over the VAWA or vice versa. For example, your spouse's citizenship status plays a critical role in your eligibility for these protections. If your spouse is not a U.S. citizen or a green card holder, you may not qualify for VAWA, but you might still qualify for a T Visa.
Some top reasons why a T Visa might be preferable over a VAWA include situations involving the permanent bar, marriage fraud, or making a false claim to U.S. citizenship. However, there are also reasons why VAWA might be more suitable, such as the quicker availability of work permits and travel documents, or receiving something called a letter of Prima Facia Determination, which can offer additional protection and benefits.
We'll also cover the differences in derivative benefits for relatives, how the process of obtaining work permits varies between the two options, and much more. Whether you're facing threats of deportation, forced labor, or other challenging circumstances, understanding the distinctions between the T Visa and the VAWA self-petition can make a world of difference in your immigration journey!
