In this video, Samir J Shah Sir, Chief Mentor and Director of JBS Academy Private Limited, talks at great length about Rules and Regulations made under Customs Act 1962. Rules and Regulations cover the administrative process on the implementation of certain sections or group of sections. A study of the Indian Customs will show a large number of Rules and Regulations which have been brought out under Customs Act.
Further, Mr. Shah moves on how to remember such Rules and Regulations. The opening paragraph of Rule or Regulation will refer to the sections of the Customs Act that it will cover in this video. So, one must be very clear that anything happening outside of those section number would not apply to these particular Rules & Regulation which you are studying. It also has a segment called definition, it is very important to study these definitions because if the word is defined in a Rule or Regulation the definition available in the Rule or the Regulation will apply. In Indian Custom, A Proper officer is listed for every activity so that that particular activity can only be done by listed Proper officer.
The Rules and Regulations will very clearly list out the timeframes and it’s important for us when we are studying the Rules and Regulations to look at the time frames and appreciate the finer differences in the time frame. It is also important to understand who will undertake a particular activity? To whom it will be reported? When & How will that activity takes place? What is the responsibility of the person? To understand the punishment for non-compliance under the particular rule or regulation may it be a penalty, suspension or revocation. It is also very important to understand the process when reading a particular rules or regulation and time limit for the given process.
