The parents are requesting that Mr. Patton be named as joint managing conservatorship with a geographic restriction of Travis County and contiguous counties. The guardian ad litem's recommendation is that Miss Trezaratti have the right to visit with the child up to two times per week for up to four hours, supervised by Mr. Patton's mother or sister. The recommendation also includes granting expanded possession and access once certain conditions are met by Miss Trezaratti.
They are requesting substantial visitation rights for Miss Trezaratti, but her work schedule makes it difficult to construct a visitation schedule. They agree that Mr. Patton should continue maintaining medical and dental insurance for the child and that neither parent pays child support. Both parents provided income evidence, and guideline child support for Miss Trezaratti would be $687 per month.
Mr. Patton would be required to pay $865 per month, after considering medical and dental costs for the child. Miss Trezaratti is requesting the release of the arrears and a child support judgment of $0. She is not requesting retroactive support, medical support, dental support, or non-disclosure at this time. They are requesting temporary orders with a return date in six months.
Miss Winton is a Guardian ad Litem who was assigned to represent the best interests of a child in a tumultuous marriage that ended in violence. She recommended that the child, Isabella, be placed in the care of Mr. Patton, who has a stable and secure environment. She outlined a plan for supervised visitation for the child's mother, Miss Trezaratti, to gradually increase over time. Despite initial conflicts, the parents have shown a willingness to cooperate for the well-being of Isabella. Both parties are committed to being a part of Isabella's life, despite their personal differences.
Miss Winton provided testimony suggesting that Miss Treasurerati may not have been as engaged in parenting as Mr. Patton, who is now the primary decision-maker for their child, Isabella. Miss Treasurerati has faced barriers such as working long hours, financial constraints, and possibly substance abuse issues. Mr. Patton has been taking care of Isabella daily since October 24th, following an agreement between him and Miss Treasurerati. Their previous 50/50 custody arrangement is no longer practical, and Mr. Patton does not believe it will work in the future due to Miss Treasurerati's work schedule and personal challenges.
Mr. Patton testified about the visitation schedule between him and Miss Trezaratti, stating that he had full custody of their daughter, Bella, with no overnight stays for Miss Trezaratti. They had sporadic visits, mostly lasting a few hours, in various locations, with some visits occurring at Miss Trezaratti's workplace. Mr. Patton expressed confidence in his ability to communicate amicably with Miss Trezaratti post-protective order expiration and emphasized their focus on Isabella's well-being. He mentioned electronic visits between Miss Trezaratti and Bella and stated his neutrality towards drug testing for Miss Trezaratti.
Miss Trezaratti is willing to do anything for her daughter, Isabella, and is open to making changes to her schedule to accommodate visitations. She currently has her own apartment and transportation, and is financially stable with a salary of $56,000 a year. She has no concerns about drug usage and disputes any claims made against her. Mr. Patton, on the other hand, has concerns about the people Miss Trezaratti associates with and their potential influence on Isabella. He is hesitant about final orders but is open to joint managing conservatorship with him as the primary managing conservator.
Child support is money paid by one parent to the other parent for the purpose of providing financial support to a child or children. Most frequently, child support is paid by the non-custodial parent to the custodial parent, but this is not always the case. Depending on where you live and the agreement you reach, the child support you pay or receive and what expenses it should cover will vary.
