According to the 1969 Vienna Convention on the Law of Treaties,
A treaty can be terminated for the following reasons:
By agreement, material breach; the supervening impossibility of performance, and fundamental change of circumstances.
Let's have a quick look.
First, by Agreement
A treaty can be terminated Under its provisions or the consent of all the parties, after consultation with the other contracting States.
Alternatively, the parties to a treaty may together decide to terminate it before its aims have been achieved.
If the purpose for which the treaty was created has been achieved, the State parties can agree to bring the treaty to an end.
A party may also withdraw from the treatyu under the same conditions.
In the absence of express provisions on termination, a right to denounce or withdraw from a treaty, is usually to be implied upon not less than 12 months' notice
Second, by Material breach.
For an innocent State to terminate or to suspend a treaty, the breach by the State in default must be material.
A material breach invoked by a state as a reason for termination or suspension in whole or in part, especially when that breach is a repudiation of a treaty or a violation of a provision crucial to the accomplishment of the object or purpose of the treaty.
Third, the impossibility of performance means there is permanent disappearance or destruction, of an object essential for the treaty's execution, provided that it is not caused by the State invoking it.
Fourth, In the event of a fundamental change of circumstances.
And lastly, Where the treaty conflicts with a new peremptory norm of general international law.
On the other side, a multilateral treaty does not terminate because the number of parties falls below the minimum
necessary to bring it into force, unless it so provides, nor is a treaty terminated by severance of diplomatic or consular relations.
