#jury instructions occurred after the #defense rested.
- Unanimous Verdict:
- Any conviction or acquittal must be unanimous.
- For each criminal charge, the jury can find Read either “guilty” or “not guilty.”
- If Read is acquitted, she cannot be retried for the same crime (double jeopardy).
- If found guilty, the next step is sentencing.
Proof Beyond a Reasonable Doubt:
To find Read guilty of a charge, all 12 deliberating jurors must agree that prosecutors proved the charge beyond a reasonable doubt.
“A charge is proved beyond a reasonable doubt if, after considering all the evidence, jurors have an abiding conviction, to a moral certainty, that the charge is true.”
Alternate jurors will likely remain in a separate room during deliberations.
They may participate if one of the 12 deliberating jurors is excused due to personal emergency or sickness.
