INDEPENDENT CONTRACTORS
In general, workers’ compensation benefits are available only to employees who are injured on the job, not to independent contractors. But in Nevada, certain workers who call themselves independent contractors may still be considered employees and may therefore claim worker’s compensation benefits. Here are five things to know:
1) Contractors in the construction industry are considered employees unless they are registered architects or licensed engineers.
2) In non-construction settings, independent contractors of a principal contractor are considered employees unless they have a lawful, written agreement stating otherwise and the independent contractor and principal contractor are in different trades.
3) Some employers misclassify employees as independent contractors to keep them from claiming workers’ compensation benefits. In these cases, the worker should contact an attorney to fight to get him or her reclassified properly as an employee.
4) Independent contractors can buy their own worker’s compensation insurance to protect them in the event they sustain a job injury.
5) Independent contractors can always bring a personal injury lawsuit against the employer following a work injury. But unlike workers’ compensation claimants who never have to prove the employer did anything wrong, plaintiffs in a traditional lawsuit have the burden to prove that the employer was at fault for their injury.
