A criminal writ can be filed in cases where the magistrate has not entertained the case. Then counsel for the complainant or the complainant himself approaches the high court under writ jurisdiction to file a case.
Another instance is that when complainant wants that CBI should investigate the matter, so a writ can be issued directing the CBI to investigate.
Another instance can be the transfer of investigation from one state to another, in such cases, the complainant can move tot he Supreme Court and file a writ because he/she feels that in the particular state there can be a biased investigation.
Also in cases where an arrest has been wrongfully made, then a writ of habeas corpus can be filed.
