Can you fire your attorney? Choosing your attorney is a big deal, and I know you put time and effort into selecting an attorney that you thought had your best interests at heart. But now you realize that that is not true. So can your fire an attorney? Today we're talking about what to do when you have a bad attorney.
First of all, YES you can terminate any attorney representation. There are a couple consequences to consider.
1. If you fire your attorney in the midst of a case, they may file a claim on your case. That means that you might owe your old attorney more money once you get your settlement, in addition to the money you owe your new attorney.
2. Firing your old attorney and getting a new one will add significant delays to your case. In a way, it is like starting over with this new attorney.
If you have an attorney who does not have your best interests at heart, or who is just doing a bad job at being your attorney it may be worth it to find a better one. I want you to be prepared for these potential consequences of replacing your attorney mid-case. It is NOT impossible!
