The African Continental Free Trade Area (AfCFTA)—arguably the widest-reaching trade area globally—officially began trading on January 1, 2021. Its scope and size mean that it could have significant development impacts across the continent. Negotiations on the agreement are currently in their second "phase," which includes the development of an intellectual property rights protocol.
The protocol aims to support the realization of the objectives of the AfCFTA as set out in Article 3 of the AfCFTA Agreement by seeking to establish harmonized rules and principles for the promotion, protection, cooperation, and enforcement of intellectual property rights. A draft of the Protocol on intellectual property rights (IPRs) to the AfCFTA was recently released to the general public.
