HOW DO I GET GUARDIANSHIP OF A CHILD RELATIVE IN NEVADA?
Nevada law allows a child's adult relatives to seek guardianship when his/her parents are unable to care for the child.
There are two general types of guardianship a relative can petition for in Nevada. Guardianship over the child, and guardians over the estate.
Guardians over the person make personal decisions that affect the child, such as supplying food, clothing and shelter, authorizing medical and dental care, and seeing that the child receives an education.
Guardians over the estate manage a child's assets, such as real property, or stocks and bonds.
Any close adult relative can be a guardian in Nevada as long as he/she is able to provide for the child's basic needs, has not abused alcohol or drugs in the previous six months, and has never been convicted of a felony or found guilty of abuse or neglect.
It normally takes two-three months to gain guardianship over a child in Nevada. In an emergency, the court can hold an expedited hearing such as if the child needs immediate medical attention or faces a substantial and immediate risk of physical or financial harm.
Guardianships usually last until the child turns 18 or the guardianship is no longer necessary. The court can extend the guardianship until the child finishes high school or turns 19, whichever happens first.
