What is a SECTION 42?
Section 42 of the Leasehold Reform, Housing and Urban Development Act 1993 can be used to obtain and extension to the lease on a leasehold property.
After 2 years of ownership a ‘section 42’ notice can be served on the freeholder under which they are legally obliged to extend the lease albeit for a fee.
If a ‘section 42’ is served before the sale of a property the benefits to be passed on to the purchaser, enabling them to take up the notice with the freeholder without needing to wait two years.
