Kesha, Dr. Luke reach settlement in defamation lawsuit
In 2020, New York Supreme Court Judge Jennifer G. Schecter ruled that Kesha had defamed Dr. Luke in a private text message to Lady Gaga. In the text message, sent in 2016, Kesha said that she and Katy Perry had been raped “by the same man,” in reference to Dr. Luke. Perry testified in a deposition that she had not been raped by the producer. The judge ruled the text was defamatory despite it being a private message.

A trial was due to begin on 19 July. The out of court settlement comes days after a New York appeals court ruled Dr Luke to be a public figure, raising the burden of proof for the producer to successfully prove he had been defamed.

Dr. Luke went on to produce and co-write much of Kesha's debut No. 1 album, "Animal," released in 2009, including her breakthrough hit "Tik Tok," which topped the Billboard Hot 100 for nine weeks. By 2012, Kesha had expressed frustration with her lack of control over her musical direction, hinting she wanted to explore her rock roots and tweeting (and deleting) she was "forced" to sing the lyrics to "Die Young" against her will, while the song was pulled from radio stations following the Sandy Hook school shooting.

Kesha and Dr. Luke have agreed to a resolution of the lawsuit, and have agreed to issue and post a joint statement regarding that resolution. In resolution of that lawsuit, Kesha and Dr. Luke each state the following.SETTLEMENT STATEMENTS:“Only God knows what happened that night. As I have always said, I cannot recount everything that happened. I am looking forward to closing the door on this chapter of my life and beginning a new one. I wish nothing but peace to all parties in involved.”- Kesha“While I appreciate Kesha again acknowledging that she cannot recount what happened that night in 2005. I am absolutely certain that nothing happened. I never drugged or assaulted her and would never do that to anyone. For the sake of my family, I have vigorously fought to clear my name for nearly 10 years. It is time for me to put this difficult matter behind me and move on with my life. I wish Kesha well.”- Dr. Luke
Kesha and Dr. Luke settle legal battle over defamation and sexual assault allegations
Dr. Luke denied the allegations and promptly filed a countersuit for defamation. A judge ultimately dismissed Kesha's case in 2016 and rejected her motion to be released from her contract with the producer and Sony, citing the statute of limitations and allegations lacking merit. Kesha then countersued Dr. Luke's defamation suit under a law that prevented lawsuits trying to intimidate accusers into silence. She was awarded a small win last month when a New York court decided Dr. Luke would be considered a "public figure" in the trial initially set for next month, subjecting him to a higher burden of proof for defamation, per Reuters.
