One of the biggest consequences about getting a DUI is the having a permanent record. Every time a person applies for a job, its right there. Many employers might look past DUI especially if it happed many years ago but others may hold it against a person. Their record screams, "I am an irresponsible person". Even if the the employer can look past the DUI they also have to consider the possibility of being sued if the person ever has another issue.
What can you do if you have a DUI on your record? Can it be expunged or sealed? No unfortunately not. Georgia has very tough regulations on record restrictions. The general rule is any conviction will stay on your record for the rest of your life. The only exception is if a person uses the first offender act or conditional discharge. However, a DUI is one of the few crimes where a person absolutely cannot use the first offender or conditional discharge act. For some reason the Georgia legislature has determined it is one of the most dangerous crimes in Georgia and does not allow the same treatment that a person would get for shooting or stabbing another person. Crazy isn't it.
Are there any other solutions? There may be. Recently there was a push to change the law so persons record could be sealed 5 years after a DUI convictions if they met certain conditions. This law ultimately failed but I think it may eventually get passed. Georgia is really behind the times. Many other states allow records to be sealed or restricted after a certain perioed of time has passed. I believe Georgia will eventually follow the lead of the many other states.
