The most glaring problem with the Pauper's Appeal or Affidavit of Inability to Pay is that it's so easy for the Tenant to claim. Very much like the CDC Eviction Moratorium Order, the rules for the Pauper's Affidavit are so weak that virtually anyone can apply for them. This gives Tenants an advantage and a clear incentive to appeal with ease.

However, there are specific steps for the Tenant to follow all throughout the appeal process when they appeal through a pauper's affidavit. Their failure to follow procedure could make the difference between 1 week or several months of additional possession.
