The Drug Free Schools and Communities Act (DFSCA) was passed in 1989 as part of the reauthorization of the Higher Education Act and requires institutions of higher education that receive federal funding to execute a drug and alcohol abuse prevention program (DAAPP) for its campus community. As recently as 2010, oversight of this Act has fallen under the Office of Federal Student Aid (FSA) within the Department of Education, the same office responsible for Clery Act enforcement. Through conducting program reviews, the FSA has discovered various challenges that schools face in executing the requirements of this legislation, including, but not limited to, improperly representing information in an institution’s annual security report (ASR).
As this is the one area in an ASR where institutions can cross-reference to other materials, it is crucial to fully understand all of the information that needs to be in the ASR itself or in the cross-referenced materials in order for an institution to fully satisfy all Clery Act requirements.
