How are assets divided in a divorce? Who gets what under the NC Divorce Laws?
Sometimes financial issues are the cause of marital problems, a legal separation, and eventual divorce. Disputes over how things are split up don't always end upon separation. Indeed, one of the more complicated and occasionally hotly disputed issues of divorce involves the distribution of the assets or what Charlotte Divorce Lawyers may refer to as the "marital estate."
That process, also know as EQUITABLE DISTRIBUTION, involves a careful review of assets and a three-step analysis, answering questions such as:
What type of asset is it?
Is it part of the marriage or is the property owned by and/or an asset of only one the martial properties?
If it is a marital asset, how much is it worth? Considering all the other marital assets, and debts, how are those assets divided and distributed?
Frankly, it can be a complicated and sometimes confusing process, especially for couples with substantial assets including a primary residence, vacation home, vehicles, retirement accounts, and other banking/checking accounts.
