This case involves Life Magazine publishing an article about a play based on a family's hostage experience, and whether the article is protected by the First Amendment. The New York Court of Appeals found that the article was not protected by the First Amendment because it was an attempt to advertise the play. The New York "Right of Privacy" statute §§ 50-51 prohibits the use of someone's name, portrait, or picture without their consent for advertising or promoting the sale of goods, but courts have limited its application to protect the free dissemination of thoughts, ideas, newsworthy events, and matters of public interest.
