(12 Mar 2010) HEADLINE:Judge rules on evidence in N.J. incest case
CAPTION: A judge in New Jersey decides a former wife can testify against her husband who is accused of raping and beating his five daughters and terrorizing the whole family. (March 12)
[Notes:ANCHOR VOICE]
NB. THIS IS A VOICEOVER TRANSCRIPT, NOT A FULL SHOT LIST.
Jurors will get to hear testimony of the extreme physical and mental abuse allegedly inflicted by a New Jersey man accused of repeatedly raping his five daughters and terrorizing his family for years.
SOT:
"he had sex with my daughter, my baby. He had an orgy with my baby and my girlfriend."
A New Jersey Judge ruled Friday that testimony from the man''s wife describing the abuse and isolation of the family is relevant to the cases...and will be allowed.
The Associated Press does not identify victims of sexual crimes...and therefore isn''t reporting the names of the husband and wife in this case.
Prosecutors are preparing to have the man stand trial five separate times...one per child victim.

Testimony includes allegations that the man ordered all children be born at home to remain undocumented.
The man also allegedly deprived the victims of food and medical care, kept them out of school and threatened them with death if they told anyone.

"What we sometimes see in these cases is a pattern of learned helplessness where the partner of the children
believe themselves or believe their efforts to be futile or believe that they have no control over impacting
change."
Family members say the allegations are shocking.
SOT:
"the rest of the family. Nah. We didn''t really know anything about the abuse, that he was abusive to the wife"
The former wife of the 51-year-old defendant testified at a hearing that he claimed to be a prophet whose apocalyptic visions drove him to try to create so-called "pure" family bloodlines by impregnating three of his teenager daughters.
SOT:Cynthia Calkins Mercado/Clinical Forensic Psychologist
"in his attempt or belief to create pure family bloodlines may be suggestive not only of some sort of psychotic
belief but also some sort of narcissistic idea about the specialness of him and his own bloodline."
The judge ruled Friday that the first of five separate trials will start in May.
SOT:
"the main part...is....how do you rebuild from this?"
A lawyer for the defendant, declined to comment after Friday''s court hearing, saying only his client remains in custody at the Passaic County Jail.
He is being held on $1 million-dollars bail.
