Warren Leonard Pay (52) was found guilty of murder by a jury trial in November 2019. Pay claimed he killed Faapaia Fonoilaepa in self-defence. He continued to protest his innocence at the Wellington High Court on Friday when Judge Helen Cull began to address Pay’s offending. Interrupting the Judge, Pay yelled in court stating he was framed, it was all lies and again stating his fatal violence was in self-defence.
Around 6.45pm on the 14th of September 2018, Mr Fonoilaepa left his home with a friend. Within an hour he was dead. Two minutes and ten seconds was all it took for Pay to start an altercation, fight with the two men and kill Mr Fonoilaepa.
Pay is a member of the Mongrel Mob. He has 25 previous convictions. Pay believed the victim and his friend belonged to a rival gang; the King Cobra’s. Pay walked down High Street in Taita wearing a metal chain linked vest and a mouth guard. Armed with a large butchers knife and a loaded homemade gun, he intentionally focused his anger towards Mr Fonoilaepa. Pay attempted to shoot Mr Fonoilaepa but his gun did not fire. The violence continued.
Pay then stabbed the victim directly in the heart. He then just walked away. Pay did return to the scene a little later, only to retrieve his personal items!
Faapaia Fonoilaepa (29) was not wearing any gang clothing or gang colours. He was not armed. Yes he fought back against Pay’s violence but he did not deserve to have his life brutally and shamefully stolen. A senseless, tragic murder of a much loved father, partner, son and friend.
Guilty of murder, the possession of an offensive weapon and carrying an imitation firearm, Pay
was sentenced to life imprisonment with a minimum non-parole period of ten years.
