John Paul Stevens was Associate Justice, Supreme Court of the United States. This talk was the keynote address delivered on October 25, 1991 at the conference "The Bill of Rights and the Welfare State," held at the University of Chicago Law School October 25-26, 1991. The proceedings of this conference were collected in the book The Bill of Rights in the Modern State, edited by Geoffrey R. Stone, Richard A. Epstein, and Cass R.
