There are six ways that help is available.
One:
The first way is where the migrant has a BRP card with no recourse public funds at the end. The Home Office has announced that the migrant may make an application for Change of Conditions, The difficulties; (i) is an application which will have to be put in to the Home Office and the Home Office has to be staffed well to address these applications, (ii) the documentary evidence required would be bank statements.
The criteria for Change of Conditions would be (i) there is a destitution - migrant is homeless or there is a high risk of destitution, (ii) the child’s welfare is at risk due to low income, or (iii) there are other exceptional circumstances.
Two:
The second way is medical treatment is also available to migrants and immigration checks would not be carried out for COVID-19 tests, medication, or medical treatment.
Three:
The third way is, if you are employed Home Office has announced that you may get help from the Coronavirus Job Retention Scheme Job Retention scheme where your employer is going to get paid by the government to pay your wages.
Fourth:
The fourth way is in the respect of housing - the Government has announced support for both renters and landlords practically it means that the tenants cannot be evicted for the next three months. The Home Office considers that is sufficient protection in the meantime.
Fifth:
The fifth way that help is available is, in the worse case scenario the Home Office is highlighting that the local authorities are also there to help for those who are elderly suffering from severe illness or disabilities or mental health.
Sixth:
The sixth way that help is available is NASS support for asylum seekers which the asylum seeker would have to contact the Home Office and get access.
For Change of Conditions application - The reservation is practically if the Home Office is short staffed and it would usually take three to six months for this application to be considered but by then if the lockdown has ceased and employers are able to take the employees back the process may be futile to follow; but no one knows what is going to happen in the future so in the meantime if you consider that your circumstances meet the criteria for Change of Conditions being (i) destitution or the risk of destitution being homeless, or (ii) that your children’s welfare is at risk because of low income, or (iii) other exceptional circumstances. In your application you may also address why the Job Retention Scheme is insufficient to allow you to meet the Financial means.
There is pressure on the Home Office to invite all migrants with financial difficulty due to COVID 19 measures but at present the Home Office has not changed any of its Immigraiton Rules as reflected by the Change of Conditions application criteria which is the same as it has always been. Therefore, if you submit the application consider not to hold your breath or put all your eggs in that basket.
