Criminal Procedure Code - Chapter 6: Powers of Public Prosecutor (CLP)
In Malaysia, Article 145(3) of the Federal Constitution expressly states that the Attorney General (or Public Prosecutor) shall have power, exercisable at his discretion, to institute, conduct or discontinue any proceedings for an offence, other than proceedings before a syariah court, a native court, or a court martial.
In other words, the Public Prosecutor has absolute discretion in deciding to commence or not commence a criminal charges against particular person.
The powers can be classified as:-
(a) institution of proceedings;
(b) conduct of proceedings; and
(c) discontinuance of proceedings.
