Legal System & Method - Chapter 3: Do Judges make law (Degree - Year 1)

Traditionally, the declaratory theory suggests that judges do not make law. Because it is the function of the legislature (or Parliament) to make law and the court (judge) merely to apply the law.

But when a judge decides a case and that decision became a binding precedent, is this considered a "law-making" process?
