Das v. Das | 754 A.2d 441 (2000)
Social standards change with the times, and the law often changes with them. Recent decades have seen increased public awareness of domestic violence and its consequences. Many courts and legislatures have responded by taking stronger measures to provide relief to the victims of abuse. In Das versus Das, a Maryland court examined how modern views of domestic violence affect the standards for divorce.
Vincent and Anuradha Das were husband and wife. They had two minor children. In January of nineteen ninety-eight, the wife obtained a domestic-violence protective order against the husband in a Maryland district court. The parties then separated, and the wife sued for divorce in a Maryland circuit court.
The husband failed to appear at the divorce trial. The wife testified that the husband abused her both physically and emotionally. She said he sometimes deprived her of sleep, isolated her from family and friends, and inflicted physical violence such as hitting her, pinching her, and pulling her hair. She further testified that the stress of the marriage caused her to have cardiac arrhythmia and other health problems. The wife’s brother corroborated aspects of her testimony.
The circuit court entered a default judgment of absolute divorce against the husband on grounds of cruelty and excessively vicious conduct. The husband brought a motion to vacate the default. The circuit court denied the motion, and the husband appealed to the Court of Special Appeals.
