One of the most common questions we get at our family-law-firm is whether dad can sign over his rights to a child to avoid child support.
The short answer is "no" this is not an option. The problem with thinking that this is a viable option is that dad will usually send mom a text message wanting to waive his rights to the child and then later dad will go to court seeking custody and mom will use that text as evidence against him.
When that happens the judge is going to believe that dad is only seeking visitation in order to lower his child support and not because he cares about the child which will hurt dad's case.
The best defense against child support is to seek as much reasonable time sharing with the child as possible.
