Chateau des Charmes Wines sued Sabaté USA for breach of contract involving the purchase of wine corks. The district court dismissed the case and said it should be handled in France due to forum selection clauses in the invoices from Sabaté France. The appeals court reviewed the decision and found that the forum selection clauses were not enforceable because they were not part of the agreement between the parties. The sale of goods was governed by the United Nations Convention on Contracts for the International Sale of Goods.
