We all know what the rules of the road are.
We all drive.
We know that a red light means stop.
We know that a green light means go.
We know that a double yellow line means you cannot cross over it.
These are almost common sense rules that we live with every day as we travel to and from work and school.
If we suffer injury as a result of careless doctor, how do we know and how does the jury know what the rules of the road are for doctors?
There's no published guidebook for jurors to determine what is and what is not appropriate for medical care and treatment.
If there are no similar rules of the road that jurors can use to judge whether a doctor violated the basic standards of medical care, what then are we supposed to do to evaluate whether treatment by a doctor is appropriate?
The answer is by bringing into court qualified board-certified experts to help the jury understand what is and is not appropriate.
There is no way for us as laypeople to know what is appropriate for a surgeon to do in the middle of surgery.
That is why it is critical for medical experts to come into court and explain in detail what is appropriate and what is not appropriate.
It is vitally important for these experts to explain what represents a departure from good and accepted medical care.

Did you know that when I question a doctor during his pretrial question and answer session known as a deposition, the doctor MUST tell me what the standard of care was?
It's true.
