On Friday attorneys for former President Donald Trump appeared in a Fulton County Court. Lawyers for Trump asked for the dismissal of the case based on what they say are various flaws in the indictment drafted by Futon County DA Fani Willis.
Steve Sadow, attorney for Trump told the court, "you take the facts as alleged in the indictment throughout the Rico count. And when you do that as applied constitutionally with the First Amendment, you find that it violates free speech, freedom of petitioning, all the expressions that the First Amendment is designed to protect. And therefore, the indictment needs to be dismissed."
Sadow's remarks mark the first time Trump's team has made any arguments since the case was first brought in August.
A Fulton County grand jury in August indicted Trump and 18 others, accusing them of participating in a wide-ranging scheme to illegally try to overturn the result of the 2020 election and to keep Trump in power even though he had lost to Democrat Joe Biden. Four defendants have already pleaded guilty after reaching deals with prosecutors. The remaining 15, including Trump, have pleaded not guilty.
