Following a leak on Wednesday, the Supreme Court justices have now officially ruled that Idaho hospitals must perform abortions in certain emergencies. In the 6-3 ruling, the justices say the exceptions to Idaho's near-total ban are too narrow. In the state, abortions are only allowed to save the life of the mother. The high court says the emergency medical treatment and active labor act allows abortions when a woman is faced with great risk to her health such as loss of fertility. The case now returns to the lower 9th Circuit Court. President of the Judicial Crisis Network and a former law clerk for Supreme Court Justice Clarence Thomas, Carrie Severino, joins to share whether she is surprised the justices sent this back down to the lower courts. The ruling provides very little legal clarity on emergency abortions. Severino tells us whether either side claimed a victory with this decision. She fills us in on what happens now with this case back in the lower courts.
