Criminal defense attorney John Guidry discusses the new law that forces judges to terminate probation early under certain conditions.
There are four requirements to qualify for this new probation law. First, you must complete half of your probationary term. Second, you must complete all of the conditions of your probation. Third, you cannot have a violation of your probation. Fourth, your original plea agreement must not state that you cannot ask for early termination of your probation.
If you meet all of these requirements, you can force the judge to end your probationary term early under 948.04(4).
However, the judge has one alternative to terminating your probation early, which is to put you on non-reporting, unsupervised probation. The judge can deny your request for good cause.
