Incidental Background Music in Your Videos - How To Avoid Copyright Infringement on YouTube

Today’s video about capturing incidental or background music is a response to a viewer’s question. Last week I posted a video looking into copyright infringement issues recording street musicians. In response, a viewer and a Youtube names Steve, TheDailyShaver asked and I’m paraphrasing … In situations where he pans around a scene, what are the copyright consequences of capturing incidental or background music, sounds or television? With Youtube’s computerized system being so good in detecting copyrighted music, how can we make sure that we don't get flagged.

The concept we are dealing with is music being incidental to or in the background to the content you’re producing. This issue falls under Fair Use. Incidental use is a small part of Fair Use.

Fair Use is a difficult issue and there are many misleading or even erroneous information being provided on YouTube with regards to this issue ...
