In New York, almost every medical malpractice case that goes to trial is heard in front of a jury.
There are rare instances however where a judge alone will try a case and decide how much compensation an injured victims should receive, if any.
However, in the majority of cases here in NY, it is the jury who makes the decision about whether an injured victim is entitled to receive full and fair compensation for all the harms, losses and damages they suffered as a result of the doctors' carelessness.
In a jury trial, the judge does not suggest or recommend to the jury a particular amount that the injured victim should receive.
There are many instances where the injured victim's attorney will suggest a number or a range that he thinks is appropriate.
The jury can agree with that.
The jury can disagree with it.
The jury can give more.
The jury can give less.
