You brought a medical malpractice case against your doctor.
You claim he was careless.
You claim his wrongdoing caused you harm and injury.
You claim you suffered permanent injury as a result of his carelessness.
Your doctor denies all of your allegations.
Your case proceeds through the discovery phase.
Depositions are done and medical records are exchanged.
Your case is on the way toward trial.
But before you even get close, once your attorney tells the court that all discovery is complete, they opposing lawyer has a limited time in which to ask the court to dismiss your lawsuit before you ever get to trial. This is known as making a motion for summary judgment.
Most defense lawyers will do everything possible to try and get your case dismissed before you get to trial. What happens if the defense fails to make this motion and never even asks the Judge to dismiss your case before trial? What does this really mean and why would the defense NOT try to get your case thrown out?
