Hi, my name is David P Shapiro. I'm a San Diego criminal lawyer. I am also the owner and managing partner of the Law Office of David P Shapiro based out of San Diego, California. And today I want to discuss with you Stalking and Harassment charges and Stalking and Harassment allegations.
If you are under investigation for stalking another person or harassing that other individual, a couple of tips that we find essential to make sure you don't make matters worse, and enable your attorney that you ultimately hire, and the law firm you hopefully eventually retain, that has, we have as many options, as many defenses as possible.
So the first step is you do not want to discuss this case, or the allegations, with law enforcement, with other people, certainly not on social media. So, you know, if someone makes accusations that you texted them, you know, 300 times in the course of a day, and you may have only texted them 30 times, the last thing you want to do is thinking you're helping yourself, and tell the cops, "Oh no, I didn't text her 30 times, I only text her, yeah, I didn't text her 300 times, I only text her the 30 times". Well, again, what you've done is you've just admitted to a, arguably, a crime. And you've corroborated at least something that the person's said against you, okay. So you want to make sure that you take that seriously.

I had a trial a couple of years ago where we went through a situation where the behavior was certainly alarming that was alleged by the alleged victim. So an individual is making claims that my client was doing A, B, C, D, and E ... was saying A, B, C, D, and E to her. And the argument was, well it's certainly cause for concern if it's true, but even if it's true, and it may seem like it's harassing or stalking in the general sense of the word, what's being alleged does not rise to the level of stalking as defined under the California law. So we were successful obtaining a Not Guilty verdict at trial for our client who was able to resume his career. He was able to restore his firearms' rights. He was able to stay out of jail. All because the attorney and the law firm that he hired knew what the law was, what the law wasn't, and was able to differentiate between what people at first glance may think is stalking or harassing, and may very well have certainly been alarming conduct. But we were able to, with his help of course, and with the resources that he invested into his case, able to present the case to a jury and show that just because they didn't like the behavior if it's true, doesn't mean that the law justified a conviction for Stalking or Harassment.
