We are delighted to be hosting Leasehold Knowledge Week in conjunction with the Leasehold London 2022 conference.
In this session titled 'Landlord and Tenant Act 1987 Rights of first refusal: the process and traps to look out for' hosted by Shabnam Ali-Khan, Partner and head of the enfranchisement team at Russell-Cooke LLP we will cover the following:
- Basics of the right of first refusal, the legislation and qualification criteria;
- Various types of right of first refusal processes including the auction process and straightforward transfer with and without contracts; things to watch out for;
- Situations where you may not think it applies including where a freehold company is willing to sell a loft space to a leaseholder. Generally this will need to be offered to the leaseholders first.
- Consequences of non-compliance with the right including criminal offence and non-compliance
