PROCESS STEPS OF EB-3 Step One –


1. Submit copy of applicant passport first biographic page (page with photo)

2. Fill out EB-3 Application Questionnaire and sign the name Step Two – Submit Form 9089 Labor certification application

1. Prepare Labor certification application document for submission
2. 6-8 months processing time to get Labor certification approved Step Three – Submit I-140 to USCIS
1. Prepare Form I-140 documents

2. Submit Immigrant petition for Alien worker (Form I-140) to USCIS a) Pay $700 to file regular petition. It usually takes approximately 6 months to get the result; b) Pay additional $2,500 Premium processing fee to expedite processing. It will take approximately 15 days to get the result.

3. USCIS approve I-140 petition. P.S. If applicant is currently holding valid non-immigrant visa such as F-1, E-1, E-2, B-1, B-2, applicant can be qualified to file adjustment of status application (I-485) in the U.S. Step Four – National Visa Center (NVC) send Visa Fee Bill notice

4. 1-2 months after I-140 is approved, National Visa Center (NVC) will notify applicant to pay visa fee bill, each person pays $345 for the Immigrant Visa processing fee (Visa Fee Bill)

5. Applicant and family members prepare birth certificate, Police certificate and marriage certificate, all the documents have to be translated to English and notarized by the government Fill out Application for Immigrant Visa and Alien Registration form (DS 260 form)

Step Five – Interview 1. Within 1-2 months, National Visa Center (NVC) completes immigrant visa processing package

2. NVC will send the package to the U.S. Consulate

3. U.S. Consulate receives package - starts processing background check with FBI and CIS

4. Within 2-4 months, U.S. Consulate notifies applicant for interview

5. Applicant and family members do medical examination for interview Applicant and family member go to interview with medical report and Employment Letter
