Attorney Tom Olsen: Hey, Rob, we have another text. And that is this, is that this landlord has gotten stuck paying for the tenant's electric and utility bills. How does a landlord end up in a situation like that?
Attorney Rob Solomon: There is a section of the Florida statute which doesn't allow what we call self-help in removing tenants, meaning you can't do things like locking doors or turning off utilities, anything like that you have to go to the courts to get an eviction accomplished if you want somebody to leave who's not willing to leave. Now, here's the rub, which is: if you have left the utilities in your own name as a landlord, court cases have held, that even in that case where you're running up a bill, you cannot shut off the electric. So the key here, and we've talked about it before, are good leases, and in that lease you are making abundantly clear, that the utilities will never be in the landlord's name, and the landlord will have no responsibility even to turn on the utility. You stay as far away from utility ownership as you can.
