If you have been arrested for a DWI, you first need to know that your license is NOT immediately suspended. Don’t forget that you must first make a request for a license hearing within 15 days of the date of your arrest.
What if you have already missed the 15 day deadline? Your license will be suspended 40 days after the date of your arrest. So, now your license is suspended – what can you do?
You need to obtain an Occupational Driver’s License (ODL). An ODL is a license for essential needs but you can pretty much drive like you always have been driving.
What are the requirements for an occupational drive’s license?
• First, you need to obtain SR-22 insurance, a form of high-risk insurance required for a DWI occupational license, and depending upon your situation, you may be required to install an Ignition Interlock Device as a condition of your occupational license.
o Quick Tip: If you are required to obtain SR-22 insurance, it is usually best to call a different insurance carrier. If you call your current insurance company, they are likely to increase your rates or cancel your coverage.
• Second, you need file a petition for occupational driver’s license
o Filing fee = $275.00 in Tarrant County, Texas
o Was your license suspended before your DWI case was completed?
If so, you will file it through the county court at law in Tarrant County. If you don’t have the money to afford it, you can actually get a packet from the Tarrant County Law Library for I think $5 or $10 that gives you the templates
o Was your license suspended AFTER a DWI conviction/plea?
If so, you will have to file it through the court you took your plea in. It will also require a copy of your driving record showing your license is clear in every other regard and then the prosecutor will have to waive a formal hearing. At that point you can get the judges signature. This is difficult to do on your own and usually helps to have a criminal attorney in Fort Worth help you with it
