The song in questioned was LEGALLY USED (i.e.: obtained via a music pool) to be used for a private event. The song was NOT edited into the video, but rather captured in the background. SCOTUS has already stated that filing against clear Fair Use is a violation of 1A. For a reference, please see Lenz v. Universal Music Corp., 801 F.3d 1126.
