When you begin a family or divorce mediation, the procedure will be on a case by case basis. The parties may be all in one room to begin with, or they may start out in separate rooms. The mediator will give an opening statement, and then the parties will have the opportunity thereafter to provide the mediator with the issues that are going to be presented at that mediation. After that point, then the mediator will try to facilitate a legally binding written settlement agreement between the two parties. Furthermore, there is private and county mediation. The latter is best when there are few issues involved and the parties mostly agree.
