Article 17 aims to help reduce the amount of online material that violates copyrights.
It requires content-sharing platforms to obtain licenses from copyright holders if possible before displaying copyright material.
If a license can’t or isn’t obtained, materials can still be displayed if the following can be shown:
1. Made best efforts to obtain licenses
2. Made best efforts not to display any copyrighted content
3. Acted expeditiously to take down any copyrighted content after receiving valid notice from the rights-holder
4. Made best efforts to prevent the re-upload of content after it’s taken down
How to comply:
- Make strong efforts to obtain copyright authorization
- Put a Notice and Takedown process in place
- Set up an Appeals process for disputing takedown notices
- Take steps to prevent the re-upload of unauthorized copyrighted content after a takedown
