In re Latrell Sprewell, NBA-NBPA Arb. (1998)
When it comes to employee discipline in professional sports, matters are handled differently than in most other workplaces. But what if an NBA player goes on a violent spree and chokes his own coach during practice? Surely, a neutral arbitrator would defer to the team and commissioner’s stern punishment for this type of egregious workplace behavior. In the case In re Latrell Sprewell, an arbitrator swatted away what others thought was a slam dunk case.
In 1992, the Golden State Warriors of the National Basketball Association, or NBA, drafted Latrell Sprewell with the 24th overall pick in the NBA draft.
Prior to the start of the nineteen ninety-seven season, the Warriors hired P.J. Carlesimo as the team’s new head coach. Roughly one month into the season, Carlesimo approached Sprewell at practice during a drill and told him that he needed to get more speed behind his passes.
In response, Sprewell slammed the ball on the ground, and Carlesimo threw him out of practice. Sprewell then grabbed Carlesimo by the neck, started choking him, and told him that he’d kill him. Eventually, Sprewell went to the locker room but later returned and threw punches at Carlesimo.
Afterward, the Warriors sought to terminate Sprewell’s contract. At the same time, the NBA commissioner David Stern imposed a one-year suspension based on his authority under the collective bargaining agreement, or CBA.
Subsequently, the NBA Players Association filed grievances against the NBA and Warriors over their disciplinary actions. An arbitrator heard the grievance.
