28/3/2022 at approximately 0221 hows, I observed a silver Lexus traveling eastbound onto
Livingston Street from Terry Avenue. The vehicle made a wide right turn and began driving in the bus lane. The vehicle then began drifting to the left and began driving between the travel lane and the bus lane. The vehicle continued to drift left and almost struck a pedestrian sign in the center of the east and west travel lanes. The vehicle then drifted back to the right back toward the bus lane.
I got behind the vehicle and initiated a traffic stop by activating my overhead emergency lights. The vehicle came to final rest at the intersection of Livingston Street and Hughey Ave.
I contacted the driver, who was identified by his Florida license as (Metro State Sergeant, Recycle). Recycle immediately said he recognized me and knew who I was stating he works at the hospital. He continued calling me by my first name and stated that I instructed him when he was a law enforcement explorer many years ago. I questioned Recycle as to our relationship and explained that I did not know him and did not remember ever meeting him. Recycle did not want to elaborate on how I knew him because my body camera was activated. Later, he made the unsolicited statement that I instructed him while he was in the law enforcement academy and taught him DUI investigations.
While standing at the driver's window, I detected the odor of alcoholic impurities coming from the vehicle. I also observed Recycle's eyes were watery and bloodshot and his speech was extremely slurred.
Based on my observed driving pattern and personal contact thus far, I requested Recycle step out of the vehicle to speak with me further.
Once out of the vehicle and speaking with me one on one and in close proximity, I was able to isolate the odor of alcoholic impurities coming directly from his facial area. I also observed Recycle had an orbital sway.
I first checked for Horizontal Gaze Nystagmus and observed the following;
Recycle had equal pupil size, equal tracking, and no resting nystagmus. I observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to forty-five degrees. No vertical gaze nystagmus was observed. Recycle had to be reminded not to move his head and to continue to look at the stimulus during the exercise.
I then administered the walk and turn exercise and observed the following (the ground was flat, level, free of debris, and well lit. A parking space divider was used for this exercise)
Recycle stepped out of the starting position one time to the right with his right foot. During the first set of nine steps, Recycle missed heel to toe (by a margin of at least a half an inch or more) on steps one, two, five, six, seven, and nine. He stopped walking to regain his balance on
step six. He stepped off the line to the right with his right foot on step number seven. He took the incorrect number of steps, taking one additional totaling ten. He completed an improper turn by stepping off the line with both feet. During the second set of nine steps, he missed
heel to toe (by a margin of at least a half an inch or more) on steps one, three, four, six, and seven. He stepped off the line to the right on step nine. Recycle used his arms for balance (by raising them six inches or more away from his body) during the exercise.
I then administered the one-leg stand exercise and observed the following (the ground was flat, level, free of debris, and well lit).
Recycle swayed while balancing, and placed his foot down on count 1003, and 1010. After placing his foot down on count 1010, he failed to pick it back up and keep counting. I asked Recycle if he was done and he picked his foot back up and continued. He placed his foot down again on count 1012. Based on the totality of the circumstances including my observed driving pattern, personal contact, and his performance during the standardized field sobriety exercises, I placed Recycle under arrest for DUI.
Recycle was transferred to the custody of Officer Flores who transported him to the Orange County DUI Center. While at the center, he requested he submit to an approved test of his breath. Negron refused to provide the samples and a refusal was called at 0406 hours.
He was then transported to the Orange County Main Jail for booking and processing.
