These appeals relate to Motor Finance undisclosed commission claims. What duty (if any) is owed where a commission has been paid to a garage which has arranged for its customer to enter into a finance agreement with a finance company.
(1) By Appellant’s Notice submitted on 5 March 2024, the claimants below, appeal the order of DDJ Morris, sitting at County Court in Kingston-upon-Hull, dated 14 September 2023, dismissing the claim.
(2) By an Appellant’s Notice submitted on 21 February 2024 the claimant/respondent below, appeals the order of HHJ Worster, sitting in County Court at Birmingham, dated 31 January 2024 which allowed the appeal of the decision of DDJ Harrop giving judgment for the claimant and remitted the claim back to County Court at Stoke on Trent.
(3) By Appellant’s Notice filed 26 July 2023, and amended by order dated 3 January 2024, the Claimant/Appellant below (C), appeals the order dated 20 July 2023 of HHJ Jarman KC sitting in County Court following judgment dated 6 July 2023 dismissing the appeal on grounds 3 and 4 and remitting the claim to DDJ Sandercock to determine afresh the claim unders.140A-C of the Consumer Credit Act 1974 (CCA).
