State v. Jones | 666 N.W.2d 142 (Iowa 2003)
The Fourth Amendment guarantees freedom from unreasonable searches and seizures by government officials. Students don’t lose that right when they go to school, but it does become limited. State versus Jones explains the reason for that limitation.
Muscatine school district policy permitted inspections of all lockers or randomly chosen lockers if the student was present or waived the opportunity to be present. Pursuant to that policy, Muscatine High School conducted an annual locker cleanout right before winter break. The stated purpose was to protect the health and safety of everyone at school and maintain school property.
Several days before the cleanout, the school notified all students that a teacher would meet them at their lockers at an assigned time on cleanout day to check the contents inside. On cleanout day, the students opened their lockers and teachers looked for food, trash, library books, and contraband. Many students, including Marzel Jones, didn’t show up for their scheduled cleanout.
The next day, staff checked the lockers that hadn’t been cleaned. One locker contained only a coat. Staff searched the coat to check for trash, school property, and contraband. They found marijuana inside a pocket and notified the principal. After consulting school records to discover the locker was assigned to Jones, the principal removed him from class, took him to the locker, and asked if it contained anything illegal. Jones snatched the coat, hit the principal, and ran. The principal caught and restrained Jones until police arrived.
The State of Iowa charged Jones with drug possession. Jones moved to suppress the marijuana evidence, arguing the locker search violated his Fourth Amendment rights.
The trial court granted Jones’s motion to suppress, finding the search unreasonable. Iowa appealed to the Iowa Supreme Court.
